shippingcenter,topromotethedevelopmentofYangshanBondedPortArea,accordingtotherelevantlaws,administrativeregulationsandthe"officialreply"oftheStateCouncilontheestablishmentofYangshanBondedPortandShanghaicityandZhejiangProvince,thejointconstructionofYangshanDeepwaterPortCooperationAgreementformulated.Seconditems(regional)YangshanBondedPortArea(hereinafterreferredtoasthebondedarea)includesasmallYangshanportarea,DonghaiBridgeandconnectedwiththespecificlandareas,theimplementationofintegratedmanagementandisclosedbyspecialfunctionofregionalcustomssupervision.ThespecificscopeofthebondedportareashallbeimplementedinaccordancewiththeStateCouncil'sreplytotheestablishmentofYangshanFreeTradePortarea.Thirditems(regionalfunction)Thebondedportmainlycarryoutthetransportationloadingandunloadingcargocontainerport,internationaltransit,internationaldistribution,internationalprocurement,internationalentrepottradeandexportprocessingbusiness,andinternationalshippingandsupportingfinancialinsuranceagents,claims,testingandotherservicesbusiness.Articlefourth(CMCanditsduties)YangshanBondedPortAreaManagementCommittee(hereinafter referredtoastheadministrativecommittee)setupbytheShanghaiMunicipalPeople'sgovernment,NanhuiDistrictDepartmentofShanghaiMunicipalPeople'sgovernment,therelevantdepartmentsofShanghaiCity,customsandinspectionandquarantineinZhejiangprovinceandtheZhoushanMunicipalPeople'sgovernmenttoparticipateintheconstruction,provincialjointcoordinationleadinggroupguideinYangshanPort,responsiblefortheday-to-daymanagementofthebondedportareathe.EntrustthecommitteecanacceptShanghaicityinZhejiangprovinceandtherelevantadministrativedepartmentsinaccordancewiththelaw,performtherelevantadministrativedutiesinthebondedportarea,andisresponsibleforthecoordinationandcooperationoftherelevantadministrativedepartmentsofport,customs,inspectionandquarantine,port,maritime,border,industryandcommerce,taxation,finance,publicsecurity,environmentalprotection,marineinthebondedportadministrationmanagementwork.Fiftharticles(portadministration,airtrafficadministrationandPublicSecurityAdministration)TheportadministrationandnavigationadministrationofYangshanDeepwaterPortAreashallbeimplementedbytheportadministrationbureauoftheShanghaiinaccordancewiththerelevantlawsandadministrativeregulationsoftheStateCouncilandtherelevantdepartmentsofthestatecouncil.Thepublicsecurity,firecontrolandroadtrafficmanagementofbondedportareasshallbeimplementedbytheYangshanbranch ofShanghaiPortPublicSecurityBureauinaccordancewiththerelevantlaws,administrativeregulationsandtherelevantdepartmentsofthestatecouncil.Sixthitems(administrativeservice)Inadditiontotheport,port,andpublicsecuritydepartmentstosetupofficesinthebondedportareawithintheDepartment,otherrelevantadministrativedepartmentsshall,inCMCorganization,regularlytothebondedportfortheenterprisetoprovidemanagementservices.Therelevantadministrativedepartmentsshallwithinthebondedareaadministrativelicenseandotheradministrativematterstoimplementtheexclusionsbutneedtobehandledonthespot,hearing,biddingandauction,inspection,testing,identification,expertsorsuperiorauthoritiesforapproval.Seventhitems(relatedserviceagencies)ThebondedportdevelopmentcompanyentrustedbytheCMChasconductedpreliminarydevelopmentofthelandwithinthebondedportareaandprovidedrelevantservicesforbothChineseandforeigninvestors.Theadministrativecommitteeshallsetuprelevantinstitutionstoproviderelevantconsultation,guidanceandagencyservicestoenterprisesinbondedportareas.Articleeighth(organizationandcoordinationofdevelopmentandconstruction) ThedevelopmentandconstructionofbondedportareashouldbeinlinewiththeplanningofYangshanDeepwaterPortofShanghaiinternationalshippingcenter,theoverallplanningofLingangNewCityinShanghai,andthemarinefunctionalzoningofShanghaiandZhejiangprovinces,Theadministrativecommitteeisresponsiblefortheorganizationandcoordination.Thenintharticle(theformulationofindustrialpolicyoriented)Theadministrativecommitteeshall,inconjunctionwiththerelevantadministrativedepartments,formulateandpublishtheindustrialpolicyguidanceofbondedportareasinaccordancewiththeguidancecatalogueoftherelevantindustrialstructureadjustmentofthestate,andrevisetheminatimelymanner.Articletenth(entrustmentofadministrativelicense)InadditiontotheadministrativeaffairsofHongKonggovernment,aviationadministrationandpublicsecurity,theadministrativecommitteeoftheShanghaiandtheZhejiangmayentrusttheadministrativecommitteewiththefollowingadministrativelicensingmatterswithinthebondedportarea:(1)examinationandapprovalofforeigninvestedprojectsentrustedbythecompetentdepartmentsofforeigninvestment; (two)approvalofinvestmentprojectsentrustedbydevelopmentandreformdepartments;(three)theapprovalopinionsoftheconstructionprojectscommissionedbytheplanningmanagementdepartment,theapprovaloftheconstructionlandplanningandtheapprovaloftheconstructionprojectplanningpermit;(four)inadditiontothenewconstructionland,thelandmanagementdepartmentcommissionedtheapprovalofthelandforconstructionprojects(includingpre-trial)andtheallocationandtransferofstate-ownedlanduserights;(five)theexaminationandapprovalofconstructionengineeringconstructionmanagementdepartmentcommissionedtheconstruction,theconstructionprojectdesignandconstructionpermit;(six)examinationandapprovaloftemporaryoccupationofroadsanddiggingroadsentrustedbymunicipalengineeringmanagementdepartments;(seven)examinationandapprovalofthedischargeanddisposalofconstructionwasteandengineeringwastesentrustedbythemunicipalenvironmentalsanitationadministrationdepartment;(eight)administrativelicensingmattersentrustedbyotherrelevantadministrativedepartmentsaccordingtolaw.Theadministrativecommitteeshallsubmittheadministrativelicenseaccordingtotheprovisionsoftheprecedingparagraph totheadministrativedepartmententrustedbytheadministrativedepartmentfortherecord,andtheentrustedadministrativedepartmentshallguideandsupervisetheadministrativelicensingmattersoftheadministrativecommittee.Theeleventhitem(approvalprocedureofconstructionproject)Theadministrativecommitteeshallexamineandapprovetheconstructionprojectsinthebondedportareainaccordancewiththedelegatedauthorityandthefollowingsimplifiedprocedures:(1)theexaminationandapprovalofforeigninvestedprojectsortheapprovalofinvestmentprojectscanbecarriedouttogetherwiththeexaminationandapprovaloftheopinionsonthesiteselectionofconstructionprojectsandthepreliminaryexaminationofthelandforconstructionprojects;(two)theapprovaloftheconstructionlandplanningpermitcanbecarriedouttogetherwiththeapprovalofthelandforconstructionprojectsandtheallocationortransferoftherighttousethestate-ownedland;(three)theexaminationandapprovalofconstructionprojectplanningpermits,construction,andconstructionengineeringdesignapprovalofconstructionprojectscanbecarriedout;(four)theexaminationandapprovaloftheconstructionpermitoftheconstructionprojectcanbecarriedouttogetherwiththeapprovalofthetemporaryoccupationofroads,excavation ofroads,discharge,disposalofconstructionwasteandengineeringwaste,etc..Theadministrativecommitteemay,inaccordancewiththeactualsituationofdifferentconstructionprojects,adjustandsimplifytheimplementationproceduresoftheadministrativelicenseprescribedintheprecedingparagraph.Thetwelfthitem(enterpriseestablishmentprocedure)TheestablishmentofanenterpriseinabondedportareashallbedecidedbytheadministrativedepartmentforIndustryandCommerceonthespotafteracceptanceofthematerialsinfullandinaccordancewiththelegalform.Theestablishmentofenterprisesinthebondedportarea,itshallbeapprovedbytherelevantadministrativedepartmentsbeforeregistrationinaccordancewiththelaw,theadministrativedepartmentsforIndustryandCommerceandManagementCommitteeorganizedtherelevantadministrativedepartmentstoimplementcentralizedmanagementofdomesticenterprises,foreigninvestedenterprises,andatthedateofacceptancetocompletetheformalitiesofexaminationandapprovalwithin5workingdays.Thirteenthitem(InformationService)Theadministrativecommitteeshall,inconjunctionwiththeport,customs,inspectionandquarantine,port,maritime,border,industryandcommerce,taxation,finance,publicsecurityandotherdepartmentstopromotetheinformation standardizationconstructionofbondedportarea,bondedportpublicinformationreleasetimely,realizetheintegrationofthebondedportareaandthesharingofinformationresources,andproviderelatedinformationserviceforelectronicdataexchangeandcustomsclearancemanagement.Fourteenth(relativelycentralizedadministrativepunishmentpower)Theadministrativecommitteeshallestablishadministrativelawenforcementagencies,andenjoytherelativelycentralizedadministrativepunishmentpowerinaccordancewiththelawintheareaswheretheadministrativejurisdictionofthebondedportareaisexercised.Fifteenthitems(lawenforcementinspection)Theadministrativecommitteeshallsupportandassisttherelevantadministrativedepartmentsinaccordancewiththelegalprocedures,performtheirdutiesinadministrativelawenforcementwithinthebondedarea;therelevantadministrativedepartmentstocompletelawenforcementmatters,shallbeinformedtothecmc.Therelevantadministrativedepartmentsinthebondedportareainthedailyactivitiesofadministrativelawenforcement,administrativecommitteeshallbeunified,centralizedarrangement;therelevantadministrativedepartmentsoftheinspectionassaultandadministrativelawenforcementactivitiesofacute,theadministrativecommitteeshall,jointlywiththerelevantadministrativedepartmenttomakethe protectionoflawenforcementpersonnelatanytime,rapidon-siteenforcementscheme.Sixteenthitems(vehicleimportandexportmanagement)Thecarriageofgoodscarryingthegoodsintoandoutofthebondedportareashallcomplywiththeconditionsstipulatedbythecustoms,enterandexitthroughthespecialchanneldesignatedbythecustoms,andacceptthecustomsexamination.ThevehiclesenteringandleavingtheDonghaiBridgeshallcomplywiththerelevantprovisionsoftheadministrativecommitteeandaccepttheinspectionoftheYangshanbranchofthePublicSecurityBureauofShanghaiport.TheCMCisresponsibleforcoordinatingthecustomsandotherrelevantaspectsoftheimplementationofthenecessaryregulatorymeasurestoensuresocialvehiclesbondedportproductionandmanagementofvehiclesaswellastheimportofYangshanpassengertransportationcenterintheEastChinaSeaBridgenormal,orderlytraffic.Seventeenth(supervisionandmanagementofmaintenanceandrepairofDonghaiBridge)TheCMCacceptstheentrustmentofShanghaimunicipalengineeringmanagementdepartment,andisresponsibleforthesupervisionandmanagementofthemaintenanceandmaintenanceofDonghaibridge.ThemaintenanceandrepairofDonghaiBridgeshouldbecarried outthroughthetenderingandbiddingmethods,accordingtothetechnicalstandardsandregulationsofthebridgemanagementofthestateandShanghai.Theeighteenthitem(simplifyexitformalities)Therelevantpersonnelofthebondedportinternalbusinessneedstogoabroad,oftenabroad,canimplementthefirstapproval,severaltimesayearabroadeffective"measuresforexaminationandapproval,orforacertainperiodofmultipletripstoHongkong,theMacaoSpecialAdministrativeRegionprocedures.Nineteenthitems(tariffandimporttax)Theimportandexportlicenseshallbeexemptedfromcustomsdutiesandimporttaxonthegoodsimportedandexportedfromthebondedportarea.Wherethereareotherwiseprovisionsinlawsandadministrativeregulations,suchprovisionsshallbestipulated.Twentiethitems(taxesonproductionandcirculation)Enterprisesinthebondedportareafortheproductionofproductssoldorshippedoverseas,exemptfromvalue-addedtaxandconsumptiontaxcorresponding;thegoodsfromthebondedportintothedomesticsales,gothroughthecustomsformalitiesinaccordancewiththerelevantprovisionsoftheimportofthegoods,andaccordingtotheactualstateofthegoodstax. Thereisnovalueaddedtaxandconsumptiontaxinthegoodstradebetweentheenterprisesinthebondedportarea.Twenty-firstitems(taxrefund)Domesticgoodsenteringthebondedportareashallberegardedasexport,andtaxrefundshallbeimplementedinaccordancewiththeregulations.Twenty-seconditems(dateofimplementation)TheseMeasuresshallcomeintoforceonNovember24,2006.
