2、lprovisionsEUROPEANUNION,onfunctionalsafetyandenvironmentalperformance,andempowertheCommissiontolaydownthetechnicalspecifications.HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle114thereof,(4)ThisRegulationshouldbewithoutprejudicetomeasuresatnationalorUnionlevelregar
3、dingtheuseofL-categoryvehiclesontheroad,suchasspecificdrivers’licenceHavingregardtotheproposalfromtheEuropeanCommission,requirements,limitationsofmaximumspeedormeasuresregulatingaccesstocertainroads.AftertransmissionofthedraftlegislativeacttothenationalParliaments,(5)Marketsurveillanceintheautomoti
4、vesector,andinparticulartheL-categoryvehiclesector,shouldbeimprovedbyenhancingthelegalprovisionsgoverningHavingregardtotheopinionoftheEuropeanEconomicandconformityofproductionandspecifyingtheobligationsSocialCommittee(1),oftheeconomicoperatorsinthesupplychain.Inparticular,theroleandresponsibilities
5、oftheauthoritiesintheMemberStatesinchargeoftype-approvalandActinginaccordancewiththeordinarylegislativeprocedure(2),marketsurveillanceshouldbeclarified,andtherequirementsrelatingtothecompetence,obligationsandperformanceofthetechnicalservicesthatperformWhereas:testsforvehicletype-approvalreinforced.
6、Compliancewiththetype-approvalandconformity-of-productionrequirementsofthelegislationgoverningtheautomotivesectorshouldremainthekeyresponsibilityofthe(1)Theinternalmarketcomprisesanareawithoutinternalapprovalauthorities,whilemarketsurveillancemaybefrontiersinwhichthefreemovementofgoods,persons,acom
