3、,ElemarNewEnglandMarbleandGranite,LLC(“Elemar”).Thisisanactionforbreachofcontract,arisingoutofElemar'sallegedfailuretopaythepriceofstonegoodsGDGclaimsitsoldandshippedtoElemar.NowpendingbeforethecourtisthePlaintiffGDG'ssummaryjudgmentmotion.Forthereasonssetfort
4、hbelow,themotionforsummaryjudgment(Dkt.#25)isDENIED.FACTSThePlaintiffMicheleRiccitelli,anItaliancitizen,istheTrusteeinBankruptcyforG.D.G.srl,acorporationorganizedunderthelawsof,andwithaplaceofbusinessin,Italy.TheDefendant,ElemarNewEnglandMarbleandGranite,LLC,i
5、sacompanylocatedinNewHaven,Connecticut.Elemarisinthebusinessofsellinggranite,marbleandotherdecorativestonesuppliestoconsumersandcontractorsforend-use,particularlyforuseinhomesandbusinessesascountertops.Thereareveryfewmaterialfactsthatareundisputed.Thepartiesag
6、reethatpriortotheshipmentsofgoodsatissueinthisaction,GDGhadonotheroccasionssoldstonegoodstoElemar.TheyagreeitwastheircustomorpracticeforElemartopayforgoodssoldtoitbyGDGinU.S.dollars.BothpartiesapparentlyagreethatstonegoodswereshippedbyGDGtoElemaronnineoccasion
7、sbetweenapproximatelyDecember2002andSeptember2003asreflectedinthenineinvoicessubmittedbyGDGinsupportofitssummaryjudgmentmotion.BothpartiesalsoagreethatonJanuary20,2004,ElemarreceivedaregisteredletterfromthePlaintiffRiccitelliseekingpaymentinthestatedamountof“E
