1、规划落后从而导致农村住宅用地规模在一定程度上失控、空置房屋大量存在的问题，隐形市场产权纠纷存在，在地方存在着同案不同判的现象。城乡一体化是促进流转的动力，土地增值收益是宅基地使用权流转的拉力，宅基地使用权流转是城镇化的必然结果，是用益物权的内在要求，是房地一体的必然前提。通过对宅基地使用权流转的必要性分析，支持了宅基地使用权自由流转的观点，并对宅基地使用权可以自由流转进行了有力的论证。通过加强宅基地管理的法律体系建设、正确处理宅基地使用权的物权性及保障性的关系，建议强化宅基地使用权的物权性质；通过推进农宅小区化建设、改革宅基地审批制度、建立统
