2、fields,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedoverseas.ArticleIIIForeignexchangereceiptsand

3、paymentsfromtradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingforeignexchangesettlementandsales(hereinafterreferredtoas“financi

4、alinstitutions”)shallreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranches(hereinafterreferredtoasthe“foreignexchangeauthorities”)shalloverseeandinspectimple

5、mentationoftheprovisionsofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimportedandexportedgoodsandtheflowsofcapitalfromthereceiptsandpaymentsofforeignexchangematcheachother,shallsubj

6、ecttheenterprises’foreignexchangereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumstancestoon-siteverificationsandinspections(hereinafterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteveri

7、ficationsonthefinancialinstitutions’regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,andaccuracyoftheirfilingoftherelevantinformation.ArticleVIITheforeignexchangeauthoritiesshallconductclassifiedmanagementoftheenterp
