2、reign-relatedfields,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedoverseas.ArticleIII

3、Foreignexchangereceiptsandpaymentsfromtradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingforeignexchangesettlementa

4、ndsales(hereinafterreferredtoas“financialinstitutions”)shallreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranches(hereinafterreferredtoasthe“for

5、eignexchangeauthorities”)shalloverseeandinspectimplementationoftheprovisionsofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimportedandexportedgoodsandtheflowsofcapitalfr

6、omthereceiptsandpaymentsofforeignexchangematcheachother,shallsubjecttheenterprises’foreignexchangereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumstancestoon-siteverificationsandinspections(hereina

7、fterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteverificationsonthefinancialinstitutions’regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,andaccuracyoftheirfilingoftherelevantinformation.Article
