2、mentinforeign-relatedfields,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedove

3、rseas.ArticleIIIForeignexchangereceiptsandpaymentsfromtradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingfo

4、reignexchangesettlementandsales(hereinafterreferredtoas“financialinstitutions”)shallreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranche

5、s(hereinafterreferredtoasthe“foreignexchangeauthorities”)shalloverseeandinspectimplementationoftheprovisionsofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimport

6、edandexportedgoodsandtheflowsofcapitalfromthereceiptsandpaymentsofforeignexchangematcheachother,shallsubjecttheenterprises’foreignexchangereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumsta

7、ncestoon-siteverificationsandinspections(hereinafterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteverificationsonthefinancialinstitutions’regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,
