2、oreign-relatedfields,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedoverseas.ArticleI

3、IIForeignexchangereceiptsandpaymentsfromtradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingforeignexchangesettleme

4、ntandsales(hereinafterreferredtoas“financialinstitutions”)shallreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranches(hereinafterreferredtoasthe

5、“foreignexchangeauthorities”)shalloverseeandinspectimplementationoftheprovisionsofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimportedandexportedgoodsandtheflowsofcapi

6、talfromthereceiptsandpaymentsofforeignexchangematcheachother,shallsubjecttheenterprises’foreignexchangereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumstancestoon-siteverificationsandinspections(h

7、ereinafterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteverificationsonthefinancialinstitutions’regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,andaccuracyoftheirfilingoftherelevantinformation.
