2、s,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedoverseas.ArticleIIIForeignexchangereceiptsandpaymentsfr

3、omtradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingforeignexchangesettlementandsales(hereinafterreferredtoas“financialinstitutions”

4、)shallreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranches(hereinafterreferredtoasthe“foreignexchangeauthorities”)shalloverseeandinspectimplementationoftheprovis

5、ionsofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimportedandexportedgoodsandtheflowsofcapitalfromthereceiptsandpaymentsofforeignexchangematcheachother,shallsubjecttheenterprises’foreign

6、exchangereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumstancestoon-siteverificationsandinspections(hereinafterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteverificationsonthefinancialinstitu

7、tions’regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,andaccuracyoftheirfilingoftherelevantinformation.ArticleVIITheforeignexchangeauthoritiesshallconductclassifiedmanagementoftheenterp
