2、,theseGuidelinesareformulatedpursuanttotheRegulationsofthePeople’sRepublicofChinaonForeignExchangeAdministration.ArticleIITheStatesetsnolimitationoninternationalpaymentsfortrade.ExportrevenuemayeitherbetransferredbacktoChinaorbedepositedoverseas.ArticleIIIForeignexchangereceiptsandpaymentsfrom

3、tradebyforeigntradeorganizations(hereinafterreferredtoas“enterprises”)shallbebasedonauthenticandlawfultradingbackgroundsandshallbeconsistentwiththeimportandexportofgoods.ArticleIVThefinancialinstitutionshandlingforeignexchangesettlementandsales(hereinafterreferredtoas“financialinstitutions”)sh

4、allreasonablyexaminetheauthenticityofthetradingdocumentsandtheirconsistencywiththeforeignexchangereceiptsandpaymentsfromtrade.ArticleVTheStateAdministrationofForeignExchangeanditsbranches(hereinafterreferredtoasthe“foreignexchangeauthorities”)shalloverseeandinspectimplementationoftheprovisions

5、ofparagraphIIofArticleII,ArticleIII,andIVhereofaccordingtothelaw.ArticleVITheforeignexchangeauthoritiesshallestablishamechanismtoinspectwhethertheflowsofimportedandexportedgoodsandtheflowsofcapitalfromthereceiptsandpaymentsofforeignexchangematcheachother,shallsubjecttheenterprises’foreignexcha

6、ngereceiptsandpaymentsfromtradetooff-siteaggregateverificationsandmonitoring,shallsubjectenterpriseswithunusualorsuspiciouscircumstancestoon-siteverificationsandinspections(hereinafterreferredtoas“on-siteverifications”),andshallcarryoutoff-siteandon-siteverificationsonthefinancialinstitutions’

7、regulatorycomplianceinhandlingforeignexchangereceiptsandpaymentsfromtradeandonthetimeliness,completeness,andaccuracyoftheirfilingoftherelevantinformation.ArticleVIITheforeignexchangeauthoritiesshallconductclassifiedmanagementoftheenterp
