2、PBC”)abodycorporateandpoliticalsubdivisionoftheStateofFlorida,whoseprincipalplaceofbusinessis3300ForestHillBlvd.,WestPalmBeach,Florida33406andTHEFLORIDADEPARTMENTOFJUVENILEJUSTICE(hereinafterreferredtoas“DJJ”),whoseprincipalplaceofbusinessis2737Cente
3、rviewDrive,Suite307,Tallahassee,Florida32399-3100.TheSDPBCandDJJshallbereferredtocollectivelyasthe“Parties.”WHEREAS,theSDPBCmustfulfillitsconstitutionalobligationtoeducatechildrenofcompulsoryschoolage;andWHEREAS,theSDPBChasdeterminedthatsomechildrenn
4、eedalternativesettingsand/orinstructionalstrategiestoachievetheireducationalgoals;andWHEREAS,thehereinafterreferredtoastheSDPBCand,andDJJmutuallyagreetoplanandimplementaprocessandprocedureforsharingofinformationthatwillresultinimprovedservicestoyouth
5、atriskandthoseinvolvedinthejuvenilejusticesystem;andWHEREAS,theSDPBCagreestoprovideaccesstoaneducationalcomponentaspartofDJJ’sprograms;andWHEREAS,DJJoperatedresidentialand/ornonresidentialprograms,eitherdirectlyorthroughprivateproviders,andtowhichPal
6、mBeachCountystudentshavebeenassignedbythecourts;andWHEREAS,thepurposeofthisCooperativeAgreement(“Agreement”)istoensurethatintheimplementationofapplicableprovisionsofFlorida’sstatutesandrules,theSDPBCistheresponsibleagencyandexercisesgeneralauthorityo
7、veralleducationalprogramswithinthedistrict;andWHEREAS,theSDPBCandDJJmutuallyagreetoacollaborativeefforttoplan,implement,andevaluateprogramswhichmeetstatutoryrequirementsforstudentsservedbyDJJyouthservicesites;NOW,THEREFORE,inconsiderationofthemutualc
