1、SECTIONOFLEGALEDUCATIONANDADMISSIONSTOTHEBARAMERICANBARASSOCIATIONCriteriaforStudentStudyataForeignInstitution(adopted2/8/2003;effective8/1/2003)PreambleStandard307providesthatalawschoolmaynotgrantcredittowardtheJ.D.degreeforstudiesoractivitiesinaforeigncountryunles

2、sthosestudiesareapprovedinaccordancewiththeRulesofProcedureandCriteriaadoptedbytheAmericanBarAssociation’sCounciloftheSectionofLegalEducationandAdmissionstotheBar.ThethreesetsofCriteriaapprovedbytheCouncilprovideaframeworkforlawschoolstograntstudentscredittowardtheJ

3、.D.degreeforstudiesabroad.Theyseektoprovideflexibilityforaschooltodesignprogramsandtopermitstudyabroadconsistentwiththeschool’sstandards,cultureandmissionwhilemaintainingalevelofoversightoftheschool’sprogramoflegaleducationthatisconsistentwiththeroleandscopeoftheSta

4、ndardsfortheApprovalofLawSchools.TheseCriteriaimplicitlyrecognizethattheprimaryresponsibilityfordeterminingthequalityoftheeducationalexperiencethatitsstudentswillreceiveduringastudyabroadexperiencerestsonthefacultyandadministrationofthelawschool.TheABA’soversightrol

5、ewithregardtoforeignstudyisimportantforatleasttworeasons.TheyprovideassuranceofasoundlegaleducationalexperienceataforeigninstitutionthathasnotbeenreviewedforcompliancewiththeStandardsfortheApprovalofLaw,isdistantfromthestudent’shomeschool,andoperatesinalegalcultureq

6、uitedifferentfromourown.Theyalsoprovideassuranceofasoundeducationalexperienceinstudyabroadsponsoredbyapprovedlawschools.ThisissignificantbecausemostlawschoolsallowtheirstudentstoenrollforcredittowardtheJ.D.degreeinaforeignsummerorsemesterabroadprogramsponsoredbyothe

7、rapprovedschoolsrelyingontheABAreviewandapprovalprocesstoassurethesoundnessofthoseprograms.I.TheProgramA.AnABA-approvedlawschoolmayallowstudentstoreceivecreditforlawstudyataforeigninstitutionconsistentwiththeseCriteria.1.Aschoolthatapproves6orfewerstudentsoveraconse
