1、设立国际油污损害赔偿基金公约(附英文)(4)6.WheretheFund,actingasaguarantorbyvirtueofparagraph2,has　paidcompensationforpollutiondamageinaccordancewiththeLiability　Convention,itshallhavearightofrecoveryfromtheownerifandtothe　extentthattheFundwouldhavebeenexoneratedpursuanttoparagraph3　fromitsobligationsunderp

2、aragraph1toindemnifytheowner.　　　7.Expensesreasonablyincurredandsacrificesreasonablymadebythe　ownervoluntarilytopreventorminimizepollutiondamageshallbetreated　asincludedintheowner'sliabilityforthepurposesofthisArticle.　Article6　　　1.RightstocompensationunderArticle4orindemnificationunder　Ar

3、ticle5shallbeextinguishedunlessanactionisbroughtthereunderor　anotificationhasbeenmadepursuanttoArticle7,paragraph6,within　threeyearsfromthedatewhenthedamageoccurred.However,　innocase　shallanactionbebroughtaftersixyearsfromthedateoftheincident　whichcausedthedamage.　　　2.Notwithstandingparag

4、raph1,therightoftheownerorhis　guarantortoseekindemnificationfromtheFundpursuanttoArticle5,　paragraph1,shallinnocasebeextinguishedbeforetheexpiryofa　periodofsixmonthsasfromthedateonwhichtheownerorhisguarantor　acquiredknowledgeofthebringingofanactionagainsthimunderthe　LiabilityConvention.　　

5、　Article7　　　1.SubjecttothesubsequentprovisionsofthisArticle,anyaction　againsttheFundforcompensationunderArticle4orindemnificationunder　Article5ofthisConventionshallbebroughtonlybeforeacourt　competentunderArticleIXoftheLiabilityConventioninrespectof　actionsagainsttheownerwhoisorwhowould,bu

6、tfortheprovisionsof　ArticleIII,paragraph2,ofthatConvention,havebeenliablefor　pollutiondamagecausedbytherelevantincident.　　　2.EachContractingStateshallensurethatitscourtspossessthe　necessaryjurisdictiontoentertainsuchactionsagainsttheFundasare　referredtoinparagraph1.　　　3.Whereanactionforco
