1、摘要近年来，从杜培武案、佘祥林案、徐梗荣案到赵作海案，刑讯逼供如同挥之不去的阴影，始终笼罩在刑事司法领域。有识之士不断呼吁，从制度层面加紧完善刑事诉讼法，在及时、准确惩治犯罪的同时，更加注重保护犯罪嫌疑人、被告人的合法权利。不得强迫自证其罪特权就是以保障犯罪嫌疑人、被告人合法权利，使其免受不公正待遇的一种权利。综观国外各个国家，大多数国家以宪法或者其他法律的形式反映了这一特权的精神实质。有的国家直接在宪法中明确规定不得强迫自证其罪原则，如美国，有的国家以沉默权的形式反映了不得强迫自证其罪的精神，如英国。我国现行刑事诉讼法没有对此

2、作出规定，2012午3月14日通过的刑事诉讼法修正案虽然对此作了规定，但较笼统，不具有可操作性，且将这一原则在证据中予以体现。本文立足于遏止刑讯逼供的司法实践需要，通过分析不得强迫自证其罪原则，梳理两大法系主要国家对不得强迫自证其罪的规定，详细论述了我国刑事诉讼引入不得强迫自证其罪的必要性和可行性，并结合国外不得强迫白证其罪原则的相关制度保障，提出我国在引入不得强迫白证其罪的同时，各项配套制度的合理设计。关键词不得强迫自证其罪沉默权刑讯逼供法律化AbstractThetortureasthelingeringshadowalwa
