3、maintainingforeigntradeorderandfaircompetition.Article2IncasethatimportedproductsenterthemarketofthePeople''sRepublicofChinabywayofdumping,andcausematerialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustry,orcauseamaterialimpedimenttotheestablishmentofado

4、mesticindustry,aninvestigationshallbeconductedandanti-dumpingmeasuresshallbetakeninaccordancewiththepresentRegulation.ChapterIIDumpingandDamageArticle3Theterm"dumping"shallrefertotheentryofimportedproductsintothemarketofthePeople''sRepublicofChina,intheordinarycourseoftrade,withtheir

5、exportpricelowerthantheirnormalvalue.TheMinistryofForeignTradeandEconomicCooperation(hereinafterreferredtoastheMOFTEC)shallberesponsiblefortheinvestigationonanddeterminationofdumping.Article4Thenormalvalueofimportedproductsshallbedeterminedinthefollowingwaysonthebasisofdifferentcircu

6、mstances:(1)incasethattheproductsofthesamecategoryasthatoftheimportedproductshaveacomparablepriceinthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,thatcomparablepriceshallbethenormalvalue;(2)incasethattheproductsofthesamecategoryasthatoftheimportedproductsare

7、notsoldonthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,orthepriceorquantityoftheproductsofthesamecategorycannotbeusedasabasisforfaircomparison,thenormalvalueshallbethecomparablepriceatwhichtheproductsofthesamecategoryareexportedtoaproperthirdcountry(region)
