3、asaprimaryobligation,thedueperformanceofalltheContractor’sobligationsandliabilitiesundertheContract,includingtheContractor’scompliancewithallitstermsandconditionsaccordingtotheirtrueintentandmeaning.IftheContractorfailstosoperformhisobligationsandliabilitiesandc
4、omplywiththeContract,wewillindemnifytheEmployeragainstandfromalldamages,lossesandexpenses(includinglegalfeesandexpenses)whicharisefromanysuchfailureforwhichtheContractorisliabletotheEmployerundertheContract.ThisguaranteeshallcomeintofullforceandeffectwhentheCont
5、ractcomesintofullforceandeffect.IftheContractdoesnotcomeintofullforceandeffectwithinayearofthedateofthisguarantee,orifyoudemonstratethatyoudonotintendtoenterintotheContractwiththeContractor,thisguaranteeshallbevoidandineffective.Thisguaranteeshallcontinueinfullf
6、orceandeffectuntilalltheContractor’sobligationsandliabilitiesundertheContracthavebeendischarged,whenthisguaranteeshallexpireandshallbereturnedtous,andourliabilityhereundershallbedischargedabsolutely.ThisguaranteeshallapplyandbesupplementaltotheContractasamendedo
7、rvariedbytheEmployerandtheContractorfromtimetotime.Weherebyauthorisethemtoagreeanysuchamendmentorvariation,thedueperformanceofwhichandcompliancewithwhichbytheContractorarelikewiseguaranteedhereunder.Ourobligationsandliabilitiesunderthisguaranteeshallnotbedischar
