2、ment,evenademocraticallyelectedgovernment,canoverridethem.Notonlythat,hebelievesthatthosefundamentalrightsincludeanaturalrighttolife,liberty,andproperty,andfurthermorehearguesthattherighttopropertyisnotjustthecreationofgovernmentoroflaw.Therighttopropertyisanaturalrig
3、htinthesensethatitisprepolitical.Itisarightthatattachestoindividualsashumanbeings,evenbeforegovernmentcomesonthescene,evenbeforeparliamentsandlegislaturesenactlawstodefinerightsandtoenforcethem.Lockesaysinordertothinkaboutwhatitmeanstohaveanaturalright,wehavetoimagine
4、thewaythingsarebeforegovernment,beforelaw,andthat'swhatLockemeansbythestateofnature.Hesaysthestateofnatureisastateofliberty.Humanbeingsarefreeandequalbeings.Thereisnonaturalhierarchy.It'snotthecasethatsomepeopleareborntobekingsandothersareborntobeserfs.Wearefreeandequ
5、alinthestateofnatureandyet,hemakesthepointthatthereisadifferencebetweenastateoflibertyandastateoflicense.Andthereasonisthateveninthestateofnature,thereisakindoflaw.It'snotthekindoflawthatlegislaturesenact.It'salawofnature.Andthislawofnatureconstrainswhatwecandoeventho
