2、hoolofJournalism&CommunicationsofChongqingUniversity,Chongqing,ChinaApril2013重庆大学硕士学位论文中文摘要摘要2010年，垫江4岁女孩小雅琳因被继母用插棍打成重伤，成为重庆媒体关注的焦点。经过媒体不间断的报道，从当年9月12日事发至11月19日，短短2个多月时间，小雅琳的继母翁光友就被一审定罪。这其中，“继母”这一身份无疑令翁光友遭遇到了媒体推波助澜式的无限放大，媒体在有意无意间的偏向性引导，令司法遭遇到了公众意见的影响。我国一直在践行依法治国的理念，媒体审判的发生无疑是与这一理念相违背的。从2001年开

3、始，不少专家学者开始意识到媒体审判的问题，媒体审判也由此逐渐被人们所熟知。法律自有一套严密的审判体系，当媒体干预进去之后，或多或少都会影响到这一体系的正常运作。媒体进行舆论监督或热点事件报道是必要的，但需要明确在报道的事前、事中，以及事后该如何正确的把握报道力度以避免对正常的司法审判造成无法估计的影响。本文通过案例分析为基本手段，从小雅琳事件入手，引入对比例证、沉默螺旋理论、波特方块模型、以及笔者从事新闻业归纳总结的“无责任受访对象”现象，就此剖析重庆媒体进行媒体审判的真相与实质，并探索解决办法。关键词：媒体审判，小雅琳，案例分析I重庆大学硕士学位论文英文摘要ABSTRACTIn
