2、emicDegreeAppliedfor:J.MSpecialty:J.MUniversity:HebeiUniversityDateofOralExamination:June,2015摘要摘要近年来，民事经济交往活动日益频繁，相应的安全隐患也不断增加，安全保障义务侵权案件逐步上升，安全保障成为与民众生活息息相关的重要问题。早在20世纪初，安全保障义务已引起国外的关注，并通过判例的方式确立了安全保障义务制度，我国对该问题的研究起步较晚，直到最高人民法院2003年发布的《人身损害赔偿司法解释》才首次规定了安全保障义务，2009年12月26日全国人大常委会通过的《侵权责任法》才首次
3、将之付诸法律。立法层面，对安全保障义务的规定较为抽象、笼统，导致司法实践中对于义务主体是否负有以及尽到了安全保障义务、侵权的因果关系怎样确定等，均存在着诸多盲区。为此，在充分阐释安全保障义务有关理论问题的基础上，结合司法实践中的典型案例，对我国安全保障义务的制度完善提出相应的对策建议：安全保障义务合理限度的确定应坚持可预见性和责任相当性原则，扩展其适用范围，释明安全保障义务标准，确定恰当的责任承担方式，汇编典型案例，以及建立具有实践特色的会商研判制度，多措并举规范法官的自由裁量权，促进安全保障义务侵权案件的裁判规范化、合法化和合理化。关键词安全保障义务侵权责任法侵权责任IAbst
