1、摘要20世纪80年代以来，我国行业协会得到了长足的发展，在社会中的作用也越来越重要，极大促进了经济社会的发展。但是我们必须清醒地看到行业协会的发展与市场经济的内在要求相比还是存在一定的差距，现状可谓不容乐观。这其中既有行业协会自身的缺陷，也有政府层面存在的问题，比如行业协会的自律性有待加强，而政府尤其是相关的立法没有跟进，导致两者之间的矛盾逐渐加深。笔者仔细观察行业协会现在的发展状况，存在的比较严重的问题是行业协会在行使惩戒权过程中产生了纠纷，不仅包括协会与成员之间的纠纷，还包括协会与第三人之间的纠纷。惩戒的措施是多样的，包括开除资格、市场禁入、罚款、名誉惩戒等，其中有些措施对于
2、违规者的惩戒是非常严厉的，有的直接损害违规者的生活与机会自由。有权利就必须有救济，相应的救济机制尚不完善，可谓任重而道远。对于救济机制的探讨，可以考虑从行业协会惩戒权的权力来源进行分析，根据权利法律授权、政府委托以及契约让渡这三种方式来源，采取相对应的救济渠道包括行政诉讼救济机制、仲裁机制、调解机制等，并在此基础上细致探讨各救济渠道的可行性。关键词：行业协会；惩戒权；救济机制IAbstractSincetheeightiesoflastcentury,industryassociationshaveseensignificantdevelopmentintheincreasing

5、dmembers,butalsobetweenassociationsandthethirdparty.Therearealotofdisciplinarymeasures,includingdismissalqualifications,marketstands,fines,honorarydisciplinaryandsoforth,someofwhichareverysevereforoffenders,andsomehavedirectdamagetothelivesandopportunitiesforoffender’sfreedom.Butwestillalongw
