1、纠纷解决视野下行政信访的实证研究--以S级信访局为例汕头大学硕士学位论文纠纷解决视野下行政信访的实证研究中文摘要行政信访作为一种行政性纠纷解决机制,它在保障民意表达渠道的畅通,监督政府公权力,弥补正式救济制度的不足等方面具有重要作用。但正式救济路径的不畅和行政信访自身角色定位不当使其陷入无法终结的“信访大潮”,引发更多社会问题。在倡导多元纠纷解决的背景下,如何改革行政信访制度,发挥其替代性的制度功能对正式救济制度的改革发展及社会稳定和谐都具有重要意义。本文通过对S市级信访局的实地调研,对市级信访的工作流程、解纷模式等方面有了深入了解,并对搜集的数据和案例进行对比分
2、析,认识到目前大量不属于行政信访解决范围的纠纷涌向信访部门,而行政信访又无力解决如此多的问题,纠纷的拖延解决触发众多重复访、集体访、缠访闹访等异常信访行为,给行政信访工作施加巨大压力。因此本文最后提出要改革完善正式救济制度,使其承担起纠纷解决的重任,对行政信访进行合理明确定位,分流信访案件,最终实现行政信访与其他正式救济制度协调配合,共同维护社会和谐稳定。关键词:行政信访;纠纷解决;改革路径I汕头大学硕士学位论文纠纷解决视野下行政信访的实证研究AbstractTheLettersandVisitssystemisakindofadministrativedispu
