1、论文题目：恶意诉讼问题研究专业：法学学生：孙金宇签名：指导老师：李创功签名：摘要随着我国社会主义法制建设的深入进行和社会公众法律意识的不断增强，公民也越來越多地选择诉讼的方式來维护口己的合法权益，与此同吋恶意诉讼问题也日趋严重。虽然我国的司法制度也□趋完善，但现阶段我国法律并未对恶意诉讼进行明确规制。恶意诉讼的存在严重影响了我国诉讼制度的完善，因此寻求规制恶意诉讼的途径，完善我国的诉讼制度已是迫在眉睫。本文共分为四个部分，文章的前两个部分主要从恶意诉讼的概念、特征、构成耍件、恶意诉讼的危害及其形成的原因全面认识和分析恶意诉讼问题，而这部分的重点是对恶意诉讼概念的界定以及对恶意诉讼构成要件的分

2、析，因为恶意诉讼的概念及其构成要件是本文的基础。文章的第三部分探讨主要法治国家对恶意诉讼的法律规制以及我国关于恶意诉讼法律规制的现状。通过对比中外的法律规制，突出我国法律规制存在的问题以及主要法治国家的立法规制对我国立法的参考价值。第四部分则主要探讨怎样完善我国对恶意诉讼的立法规制，这部分主要根据恶意诉讼在我国形成的原因提出一些自己的立法建议，完善我国对恶意诉讼的法律规制。【关键词】恶意诉讼侵权行为法律规制【论文类型】理论研究Title:ResearchonMaiiciousLitigationMajor:LawscienceName:SunJinyaoSignature：Superviso
