2、fthissectionwillbeusedbytheCommissioninmakingapreliminarydeterminationthatmetalorglassedgesontoysandotherarticlesintendedforusebychildrenunder8yearsofage,andsuchedgesexposedinnormaluseorasaresultofreasonablyforseeabledamageorabuseofsuchtoysandarticles,presentapotentialrisk

3、ofinjurybylacerationoravulsionundersection2(s)oftheFederalHazardousSubstancesAct(15U.S.C.1261(s)).TheCommissionwillfurtherevaluatetoysandotherarticleswithedgesthatareidentifiedaspresentingapotentialriskoflacerationoravulsioninjurytodeterminetheneedforindividualproductregul

4、ation.(b)Scope—(1)General.Thesharpedgetestofparagraph(d)ofthissectionisapplicabletotoysorotherarticlescontainingmetalorglassedgesthatareintroducedintointerstatecommerceafterMarch26,1979.SucharticlesmanufacturedoutsidetheUnitedStatesareintroducedintointerstatecommercewhenfi

5、rstbroughtwithinasU.S.portofentry.SucharticlesmanufacturedintheUnitedStatesareintroducedintointerstatecommerce(a)atthetimeoffirstinterstatesale,or(b)atthetimeoffirstintrastatesaleifoneormorecomponentsand/orrawmaterialswerereceivedinterstate,whicheveroccursearlier.(2)Exempt

6、ions.(i)Toysandotherchildren'sarticlesthatarethesubjectofanyofthefollowingregulationsareexemptfromthis§1500.49:Theregulationsforbicycles,non-full-sizebabycribs,andfull-sizebabycribs(parts1508,1509,and1512ofthischapter).(ii)Toysthatbyreasonoftheirfunctionalpurposenecessaril

7、ypresentthehazardofsharpmetalorglassedgesandthatdonothaveanynonfunctionalsharpmetalorglassedgesareexemptfromthissection:Provided,thetoyisidentifiedbyaconspicuous,legible,andvisiblelabelatthetimeofanysale,ashavingfunctionalsharpmetalorglassedges.Examplesoftheseareapairoftoy
