2、lbeconstruedandadministeredtosecurethejust,speedy,andinexpensivedeterminationofeveryaction.Rule2OneFormofActionThereshallbeoneformofactiontobeknownascivilaction.II.COMMENCEMENTOFACTION;SERVICEOFPROCESS,PLEADINGS,MOTIONS,ANDORDERSRule3CommencementofActionAcivila
3、ctioniscommencedbyfilingacomplaintwiththecourt.Rule4Summons(a)Form.Thesummonsshallbesignedbytheclerk,bearthesealofthecourt,identifythecourtandtheparties,bedirectedtothedefendant,andstatethenameandaddressoftheplaintiff'sattorneyor,ifunrepresented,oftheplaintiff.
4、Itshallalsostatethetimewithinwhichthedefendantmustappearanddefend,andnotifythedefendantthatfailuretodosowillresultinajudgmentbydefaultagainstthedefendantforthereliefdemandedinthecomplaint.Thecourtmayallowasummonstobeamended.(b)Issuance.Uponorafterfilingthecompl
5、aint,theplaintiffmaypresentasummonstotheclerkforsignatureandseal.Ifthesummonsisinproperform,theclerkshallsign,seal,andissueittotheplaintiffforserviceonthedefendant.Asummons,oracopyofthesummonsifaddressedtomultipledefendants,shallbeissuedforeachdefendanttobeserv
6、ed.(c)ServicewithComplaint;byWhomMade.(1)Asummonsshallbeservedtogetherwithacopyofthecomplaint.Theplaintiffisresponsibleforserviceofasummonsandcomplaintwithinthetimeallowedundersubdivision(m)andshallfurnishthepersoneffectingservicewiththenecessarycopiesofthesumm
7、onsandcomplaint.(2)Servicemaybeeffectedbyanypersonwhoisnotapartyandwhoisatleast18yearsofage.Attherequestoftheplaintiff,however,thecourtmaydirectthatservicebeeffectedbyaUnitedStatesmarshal,deputyUnitedStatesmarshal,orotherpersonorofficerspeciallyappointedbytheco
8、urtforthepurpose.Suchanappointmentmustbemadewhentheplaintiffisauthorizedtoproceedinformapauperispursuantto28U.S.C.§1915orisauthorizedtoproceedasaseamanunder28U.S.C.§1916(d)W
