1、usinesscontractualrelationsAssessment3I.Outlinethegeneralprinciplesofthelawofdelict>ThelawofDelict,likethelawofContract,isapartoftheLawofObligations.Delictmeansacivilwrongcommittedbyapersonindeliberateornegligentbreachofalegalduty,fromwhichliabilitytomakereparationforanyconsequentiallossorinj
2、urymayarise.Delictisalsoknownasthelawof"civilwrongs5andappliestomuchofthesameareaoflawastheEnglishlawof'tortGeneralprinciplesofdelictualliabilityincludessomeelements:alossorinjury,suchasphysicalorpersonalinjury,thelossofearnings,nervousshock,distress,damagetoareputation;causedbylegalwrong(wr
3、ongfulconduct);causedbyculpa(fault,intentionallyornegligentlydone)onthepartofthewrongdoe匚Twoexceptionswillbediscussedlater—1)vicariousliability,wherethedefenderisliablefortheactionsofanther;and2)strictliability,whereliabilitycanarisewithoutfaultthroughstatutoryprovision.InthecaseofDrewvWester
4、nSMT(1947),thedefenderswereheldtobejointlyandseverallyliable.Incertaincircumstances,someonecanbeliableforanother'sdelictualact.Thiscanarisethroughagency,partnershipandemployment.Foroutpurposes,wewillconcentrateontheliabilityofanemployerforhis/heremployee.Aswehaveseen,thecommonlawofnegligencer
5、equiresastandardofcarewhichisbroadlydefinedasreasonablecareinthecircumstances.Iftheemployerissuedandfoundliable,thens/he(ortheinsurancecompany)cansuetheemployeeforamountthathasbeenpaidindamages.InthecaseofListervRomfordIceandColdStorageCo(1957),thecompanyinsurerspaidthefatherandthenbroughtasu
6、ccessfulactionagainstthesonfortheamountpaid.2.ExplainthepointstobeconsideredforaclaimofnegligencetoariseNegligenceisthemostcommondelictandanactionindelictariseswhereharmiscausedcarelesslyorinadvertently.Aclaimtoariseinnegligence,thefollowingpointsmustbeconsidered:1.wasadutyofcareowedbythedefe
