1、RESIDENTIALCONSTRUCTIONAGREEMENTLicenseNo.THISAGREEMENTismadethisdayof,20,byandbetween(ABuilder@),and(aOwners@)fortheconstructionofasingle-familyresidencefortheownersofpropertylocatedinCounty,StateofFlorida,andlegallydescribedasLotBlockoftheSubdivisio
2、nandalsoknownandnumberedas.TheBuilderandOwnersagreeassetfollows:1•ContractDocuments.ThetermsofthiscontractincludetheconditionsofthiscontractandbyrefereneetheprovisionsintheotherdocumentsspecificallylistedinExhibitA.Thetermsofthisagreementshallprevailo
3、veranyconflictingprovisionsinthedocumentsincorporatedbyreference.Ifaconflictexistsbetweentheplansandthespecifications,thespecificationsshallgovern.2.TheWork.Unlessotherwisespecificallynoted,Buildershallprovideandpayforalllabor,materials,equipment,tool
4、s,constructionequipmentandmachinery,transportation,andotherfacilitiesandservicesnecessaryfortheproperexecutionandcompletionoftheresidenee.Theworkshallbedonesubstantiallyinconformancewiththeplansandspecificationsthathavebeeninitialedorsignedbyeachparty
5、.TheseplansandspecificationsareattachedtothiscontractandincorporatedintoitasExhibitA.Buildershallnotberesponsibleforthefollowingwork:haulingexcavationandexistingdebrisfromtheproperty,off-siteutilityconnections;installationorconstructionofwalks,pavemen
6、ts,orcurbing;installationofcabletelevisionwiring;interiorpaintingofgarage;andanyotherworknotdescribedinthePlansandSpecifications.3.Financing.ThiscontractiscontingentuponOwnersobtainingaconstructionloanintheamountofDollars($).Allfeesandexpensesofobtain
7、ingaloanincludingallcommissions,titlecharges,andcreditreportsshallbebornebyOwners.BuilderisnotrequiredtobeginconstructionuntilOwnersprovideBuilderwithwrittennoticefromthelenderthatOwnershaveclosedonsaidloan.IfOwnerscannotobtainfinancingwithinthirty(30
8、)daysfromthedateBuilderapprovesthiscontract,eitherpartyhasten(10)daysthereaftertoelecttoterminatethiscontractbygivingwrittennoticetotheotherparty.BuildershallrefundtoOwnersallmoneypaidlesscostsandobligationsincurredbyBuilderatOwners1request.4.
