2、EEZandcontinentalshelfexists.Second,theappropriateformofthedelimitationisasinglemaritimeboundarydrawnbytheapplicationoftheequidistance/specialcircumstancesrule.Third,theCoffIslandisarelevantcircumstanceinthiscaseanditshallbegivenfulldelimitationeffectinthepresentcas
3、e.Forth,theTribunalhasjurisdictionoverthedelimitationofthecontinentalshelfbeyond200nauticalmiles.NowIwillproceedtomakethefirsttwopleadingsandmyco-counselwillmaketheothertwopleadings.TheApplicant’sfirstpleadingisthatthereisnocustomarylinedelimitingtherespectiveEEZand
4、continentalshelf.Firstly,ThereisnoagreementbetweenthePartiestosupporttheexistenceofanycustomaryline.Article74ofUNCLOSprovidesthatonlyifthereisaneffectivedelimitationagreementoftheEEZandthecontinentalshelfbetweentheparties,itmaybeaccordedpriority.Otherwisetheprocedur
5、eunderUNCLOSshouldbefollowedtoresolvethedelimitation.Inthepresentcase,thereisnodelimitationagreementoftheeezandcontinentalshelfbrtweentheparties.The1961TreatybetweenKrensburgandAllbekisnotadelimitationagreementoftheEEZandcontinentalshelf.Initially,inthescopeofstatut
6、elaw,thenotionoftheEEZonlyoccursinUNCLOS.Moreover,inthescopeofcustomarylaw,therulesregardingtotheEEZwereestablisheduntil1985andbecameanessentialmattertoeverycoastalstates.Besides,therulesof“continentalshelf”todayisnotequivalenttothatof1961.Comparingtherulesregarding
7、tocontinentalshelfin1958ConventionontheContinentalShelfand1982conventiononthelawofthesea,itcanbeconcludedthattherearearemanydifferencesbetweenthem.Theintentionsbehindthesetworulesaretotallyinconsistent.ThelatteroneisnotonlybasedontheestablishmentoftheEEZ,butalsostro
