1、AgreementonSafeguards(SG)Members,HavinginmindtheoverallobjectiveoftheMemberstoimproveandstrengthentheinternationaltradingsystembasedonGATT1994;RecognizingtheneedtoclarifyandreinforcethedisciplinesofGATT1994,andspecificallythoseofitsArticleXIX(EmergencyActi

2、ononImportsofParticularProducts),tore-establishmultilateralcontroloversafeguardsandeliminatemeasuresthatescapesuchcontrol;Recognizingtheimportanceofstructuraladjustmentandtheneedtoenhanceratherthanlimitcompetitionininternationalmarkets;andRecognizingfurthe

3、rthat,forthesepurposes,acomprehensiveagreement,applicabletoallMembersandbasedonthebasicprinciplesofGATT1994,iscalledfor;Herebyagreeasfollows:Article1:GeneralProvisionbacktotopThisAgreementestablishesrulesfortheapplicationofsafeguardmeasureswhichshallbeunde

4、rstoodtomeanthosemeasuresprovidedforinArticleXIXofGATT1994.Article2:Conditionsbacktotop1.AMember(1)mayapplyasafeguardmeasuretoaproductonlyifthatMemberhasdetermined,pursuanttotheprovisionssetoutbelow,thatsuchproductisbeingimportedintoitsterritoryinsuchincre

5、asedquantities,absoluteorrelativetodomesticproduction,andundersuchconditionsastocauseorthreatentocauseseriousinjurytothedomesticindustrythatproduceslikeordirectlycompetitiveproducts.2.Safeguardmeasuresshallbeappliedtoaproductbeingimportedirrespectiveofitss

6、ource.Article3:Investigationbacktotop1.AMembermayapplyasafeguardmeasureonlyfollowinganinvestigationbythecompetentauthoritiesofthatMemberpursuanttoprocedurespreviouslyestablishedandmadepublicinconsonancewithArticleXofGATT1994.Thisinvestigationshallincludere

7、asonablepublicnoticetoallinterestedpartiesandpublichearingsorotherappropriatemeansinwhichimporters,exportersandotherinterestedpartiescouldpresentevidenceandtheirviews,includingtheopportunitytorespondtothepresentationsofotherpartiesandtosubmittheirviews,int

8、eralia,astowhetherornottheapplicationofasafeguardmeasurewouldbeinthepublicinterest.Thecompetentauthoritiesshallpublishareportsettingforththeirfindingsandreasonedconclusionsreachedonallpertinentissuesoffactand
