1、中文摘要随着我国企业在海外的不断上市，海外上市的法律制度已经成为一项重要的制度展示在我们的眼前。企业在海外上市的最终目的是实现海外融资，获得企业发展的资金支持，但是机遇与风险同在，由于各个国家和地区上市法律制度存在在差异，表现在上市条件、资格审查、上市程序、法律监督等方面，这些都对我国的企业在海外上市提出了更严格的要求。本文从中国企业海外上市的概念和发展过程出发，力图把中国企业在海外上市涉及的概念、企业性质和法律监督等问题进行了叙述与介绍，紧接着从法理学、政治学、经济学的角度对中国企业海外上市法律风险进行了理论分析，为这一问题奠定了理论基础，同时引出了下文我国企业在海外上市的具体现
