1、基础金融普遍服务制度研究摘要基本银行账户为人们提供一系列的交易和支付服务，并连接到可负担的信贷和储蓄产品；储蓄能为人们构建资产，应对重大生活危机和弥补意外事件造成的损失；转账/汇款和支付服务能便利商品流通。获得基础金融服务应当是基本人权的重要内容之一，它能提高低收入人口的理财能力、应对经济风险的能力、增强社会归属感。为治理金融排斥，使所有人都能获得基础金融服务，有必要构建基础金融普遍服务制度，要求特定金融机构尤其是银行业金融机构针对上述基础金融服务承担普遍服务义务：在现有营业网点或分支机构，应当对符合

2、条件的申请人就地、当面提供基础金融服务，非经法定理由不得拒绝；在撤并营业网点或分支机构时，应当对利益相关人提前作出通知，并提供替代服务、做好相应的培训工作；此外，可通过行业自律规范倡导金融机构积极履行社会责任，强化服务意识等。金融机构因履行普遍服务义务造成的成本损失可通过普遍服务基金获得适当比例的补偿。在普遍服务制度运行过程中，政府部门的监管以及市场约束必不可少，金融机构不履行或不完全履行普遍服务义务的应当承担相应的法律责任。关键词：基础金融服务普遍服务义务义务主体普遍服务基金政府监管市场约束IRES
