1、摘要工程索赔是建筑业市场化的产物，是平衡买方市场的“游戏规则”，也是承包商获取赔偿、提高经济效益的关键途径，索赔的成功与否是衡量承包商合同管理成功与否的重要因素。工程索赔领域研宄在我国尚处于起步阶段，大多数理论都是基于对国外索赔案例及管理方法的分析，从事索赔研究的专业机构及经验缺乏。工程索赔及管理在我岡工程建设中还是一个相对薄弱的环节，积极开展索赔工作的总结、研究，增强工程索赔意识，按照法律法规和国际惯例实施索赔，不仅对现行工程建设管理体制改革的深入发展，对市场机制的健全完善，而且对整个建筑市场的健康发展都

2、有着重要意义。木文首先介绍了工程索赔的含义，然后从多个方面分析了建设工程中引起索赔的原因，接着通过阐述国内外工程索赔的发展现状，提山我国工程索赔存在的问题及工程索赔水平落后造成的不良后果，针对这些典型问题，分别从完善工程索赔法规、提高索赔意识等角度提出解决方法和对策以提高我国索赔管理水平，使索赔能够顺利进行，把我国的工程索赔管理水平推上一个更高的台阶，从而提高我国的工程管理水平并正确应对国际竞争。关键词：工程索赔；发展现状；问题；对策ABSTRACTEngineeringclaimistheproducto
