1、行政诉讼驳回诉讼请求判决研究摘要：行政诉讼判决，是行政诉讼最重要的结案方式，是人民法院对行政案件中实体问题所作的处理。1989年我国颁布的《行政诉讼法》确定了维持、撤销、履行和变更四种判决形式，初步建立了我国的行政判决制度。2000年最高人民法院在《关于执行<中华人民共和国行政诉讼法>若干问题的解释》中新增了驳回诉讼请求判决和确认判决两种判决形式，补充和发展了我国的行政诉讼判决制度。驳回诉讼请求判决与维持判决是人民法院审结行政案件使用较多的判决形式，理论界和实务界对这两种判决形式的具体适用存在争议。本文通过对行政诉讼驳

2、回诉讼请求判决适用的实证分析和理论研究，分析驳回诉讼请求判决在具体适用中存在的问题和缺陷，得出驳回诉讼请求判决符合司法的本质属性和诉讼法原理，且不违背行政诉讼合法性审查原则的观点，并对取消现有的维持与确认合法有效判决，在《行政诉讼法》修改时明确规定驳回诉讼请求判决，并扩大和明确其适用范围提出自己的建议。关键词：行政诉讼；驳回诉讼请求判决；维持判决；确认有效判决Abstract:Judgmentofadministrativelitigation,administrativelitigationisthemostimpo
