2、gtotheinvestigationandapplicationofantidumpingmeasures.THEPRESIDENTOFTHEREPUBLIC,intheexerciseofthedutiesandpowersconferredbyarticle84,sub-paragraphsIVandVI,oftheBrazilianFederalConstitutionandtakingintoaccounttheprovisionsoftheAgreementonImplementatio
3、nofArticleVIoftheGeneralAgreementonTariffsandTrade–GATT/1994(AntidumpingAgreement),approvedbyLegislativeDecreeNo.30,dated15December1994,andenactedthroughDecreeNo.1355,dated30December1994,andofLawNo.9019,dated30March1995,underthesectiongoverningapplicat
4、ionofthemeasuresprovidedforintheAntidumpingAgreement,HEREBYDECREES:ChapterIPRINCIPLESANDATTRIBUTIONSArticle1.Anti-dumpingmeasuresmaybeappliedwhereimportsofdumpedproductscauseinjurytodomesticindustry.Paragraph1.Anti-dumpingmeasuresshallbeappliedpursuant
5、toinvestigationsinitiatedandconductedinaccordancewiththeprovisionsofthisDecree.Paragraph2.Noimportedproductshallbesimultaneouslysubjecttoananti-dumpingdutyandacountervailingmeasureforthepurposeofneutralizingthesamesituationofdumpingorexportsubsidy.Arti
6、cle2.BasedontherecommendationsoftheDepartmentofTradeRemedies(DECOM)oftheSecretariatofForeignTrade(SECEX)oftheMinistryofDevelopment,Industry,andForeignTrade(MDIC),theCouncilofMinistersoftheChamberofForeignTrade(CAMEX)shallrenderdecisionson:I.applyingore
7、xtendingthedurationofprovisionalordefinitiveanti-dumpingduties;II.acceptingorextendingthedurationofpriceundertakings;III.theretroactivecollectionofdefinitiveanti-dumpingduties;IV.theextendingthescopeofdefinitiveanti-dumpingduties;V.theformofapplication
8、ofanti-dumpingduties,aswellasitsalteration;VI.suspendinginvestigationsforproducersorexportersforwhompriceundertakingshavebeenacceptedpursuanttoarticle67;VII.suspendingtheenforcementofdefinitiveanti-dumpingdutiesleviedthroughmandatorycas
