2、proceduresrelatingtotheinvestigationandapplicationofantidumpingmeasures.THEPRESIDENTOFTHEREPUBLIC,intheexerciseofthedutiesandpowersconferredbyarticle84,sub-paragraphsIVandVI,oftheBrazilianFederalConstitutionandtakingintoaccounttheprovisionsoftheAgreement
3、onImplementationofArticleVIoftheGeneralAgreementonTariffsandTrade–GATT/1994(AntidumpingAgreement),approvedbyLegislativeDecreeNo.30,dated15December1994,andenactedthroughDecreeNo.1355,dated30December1994,andofLawNo.9019,dated30March1995,underthesectiongove
4、rningapplicationofthemeasuresprovidedforintheAntidumpingAgreement,HEREBYDECREES:ChapterIPRINCIPLESANDATTRIBUTIONSArticle1.Anti-dumpingmeasuresmaybeappliedwhereimportsofdumpedproductscauseinjurytodomesticindustry.Paragraph1.Anti-dumpingmeasuresshallbeappl
5、iedpursuanttoinvestigationsinitiatedandconductedinaccordancewiththeprovisionsofthisDecree.Paragraph2.Noimportedproductshallbesimultaneouslysubjecttoananti-dumpingdutyandacountervailingmeasureforthepurposeofneutralizingthesamesituationofdumpingorexportsub
6、sidy.Article2.BasedontherecommendationsoftheDepartmentofTradeRemedies(DECOM)oftheSecretariatofForeignTrade(SECEX)oftheMinistryofDevelopment,Industry,andForeignTrade(MDIC),theCouncilofMinistersoftheChamberofForeignTrade(CAMEX)shallrenderdecisionson:I.appl
7、yingorextendingthedurationofprovisionalordefinitiveanti-dumpingduties;II.acceptingorextendingthedurationofpriceundertakings;III.theretroactivecollectionofdefinitiveanti-dumpingduties;IV.theextendingthescopeofdefinitiveanti-dumpingduties;G/ADP/N/1/BRA/3-4
