2、解释,法律推理EVALUATIONANDANALYSISOFLEAGLARGUMENTIONTHEORYAbstractInthepastdecades,thetheoryoflegalargumentationhasbeendevelopedandpresentedasanimportantfieldofstudyinbothEuropeanandAmericanacademiccircles,whichhasalsobeenthemostimportantfindingsintoday'sstudyoflegalmethodology.S

3、uchresearchincludesalotoftopics,butthepaperaimsatstudyofproblemsinlegalargumentationinjudicialprocess,especiallysomeissuesinbasictheoryoflegalargumentationfromperspectiveofjudicialprocess.Thepurposeofthearticleistoindicatethatitisnecessarytoshowtheprocessofthelegalargumenta

4、tion.Facedwiththepresentwayoftheinterpretation，wefoundthattheprocessofthelegalargumentationshouldconsistoftwoaspects:Firstly，aftercomplyingwiththedefiniteruleandform,thejudgecanjustifyhisorherviewoftheinterpretationabouttheparticularcase.Secondly,afterestablishingjustandrat

5、ionalprocedure，thejudgeandtheplaintiffandthedefendantwillgetjusticecircumstancesinordertodialogueandargueeachother.Beprovidedwithabovementionedrequirement，thejudgecanjustifytheparty'sviewoftheinterpretation.Thewriterthinksthattheprocessofthelegalargumentationshouldhaveitsfo

6、rmtoshowit，thatisthewrittenjudgment.Wethinkthewrittenjudgmentshouldshowtheprocessofthelegalargumentationinordertoincreasetherationalizationofthejudgment.Allofthesearemainquestionsandmainopinionsofthearticle.Thearticleconsistsoffourparts.Partone,thewriterfirstintroducestheri
