1、内容摘要近年来，随着我国水资源短缺与社会经济发展的矛盾日益尖锐，社会各界包括法学界对节约用水重要性的认识逐步提高。本文试图从法律制度的建立与完善的角度，探讨节约用水的新途径、新办法。本文首先从节水制度的研究状况入手，在节水制度的研究成果、理论研究的薄弱环节、研究的发展趋势等三个方面，对节水制度研究现状进行了概述，为论文研究提供了宏观理论背景。接着，对我国节水制度建设中存在的问题和不足进行了梳理和研究，总结提炼出以下几个方面的观点：水资源产权虚置、经济杠杆未能得到充分运用、公众参与缺乏体制性渠道、制度体系不配套，法律制度保障不到

2、位、节水技术的研究、发展和应用缺乏制度推动力等等。在对我国节约用水事业发展的现状分析、国外节水制度建设的成功经验，以及构建和完善节水制度的理论进行系统分析、综合归纳的基础上，研究论证了节水制度建设的紧迫性、必要性、可行性。最后，本文从完善新水法中节水制度实施细则、建立水权和水交易机制、保障机制等三方面，提出了构建和完善我国节水制度的对策和构想。在行文中尤其注意突出制度之间的相互配套衔接和操作可行，以期能够为推动我国节约用水工作有所裨益。关键词：节约用水节水型社会节水制度水权水价AbstractRecently，withthei
