2、to16,2005SUPPLEMENTARYINTERNATIONALSEARCHESDocumentpreparedbytheInternationalBureauSUMMARYProposalsandoptionsarepresentedforasystemofsupplementarysearcheswithinthePCT,wherebyanapplicantwouldhavetheoptiontorequestsearchestobeperformedbyInternationalAuthorities,oth
3、erthantheInternationalSearchingAuthoritythatperformsthe“main”internationalsearch,primarilyinordertolocatepriorartinlanguageswhichmightnotbefullyconsideredbythatmainAuthority.Theproposalsseektofindthemostappropriatebalanceofserviceandconveniencetotheapplicant,effi
4、ciencyofprocessingfortheInternationalAuthoritiesinvolved,andusefulnesstothedesignatedandelectedOfficesandthirdparties.EachInternationalAuthoritywouldbefreetodecidewhetherornottoparticipateintheproposedsystemofsupplementarysearches.TheMeetingisinvitedtodiscussthep
5、roposalswithaviewtoanimproveddraftbeingmadeavailablefordiscussionattheeighthsessionoftheWorkingGrouponReformofthePCT,andtoindicatetheextenttowhichdifferentAuthoritiesmightbeabletooffersuchservicesinthemediumterm.PCT/MIA/12/2page16BACKGROUNDAccordingtoArticle15,Re
6、ferencesinthisdocumentto“Articles”and“Rules”aretothoseofthePatentCooperationTreaty(PCT)andtheRegulationsunderthePCT(“theRegulations”),ortosuchprovisionsasproposedtobeamendedoradded,asthecasemaybe.Referencesto“nationallaws,”“nationalapplications,”“thenationalphase
7、,”etc.,includereferencetoregionallaws,regionalapplications,theregionalphase,etc.theobjectiveoftheinternationalsearchis“todiscoverrelevantpriorart”.Inprinciple,priorartforthepurposesofthePCTisaconceptindependentofplaceorlanguageofdisclosure:theInternationalSearchi
