2、源入手，首先介绍了期待可能性理论的起源、演变与发展；其次记述了期待可能性理论的价值内涵和判断标准；最后分析了期待可能性在我国刑法中使用的必然性以及在刑法、司法实践中的具体运用情况，并结合我国的具体实际情况提出了新时期下期待可能性理论的深入适用，希望期待可能性的理念能实现我们对于保障人权和惩罚犯罪的初衷。关键词：期待可能性；癖马案；阻却责任；必要性与可行性Abstract：Expectedpossibilitywasbornin1897inGermany"horse"addiction,legalscienceinheritsandde
