3、haviewtomaintainingforeigntradeorderandfaircompetition.Article2IncasethatimportedproductsenterthemarketofthePeople''sRepublicofChinabywayofdumping,andcausematerialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustry,orcauseamaterialimpedimenttotheestab

4、lishmentofadomesticindustry,aninvestigationshallbeconductedandanti-dumpingmeasuresshallbetakeninaccordancewiththepresentRegulation.ChapterIIDumpingandDamageArticle3Theterm"dumping"shallrefertotheentryofimportedproductsintothemarketofthePeople''sRepublicofChina,intheordinarycours

5、eoftrade,withtheirexportpricelowerthantheirnormalvalue.TheMinistryofForeignTradeandEconomicCooperation(hereinafterreferredtoastheMOFTEC)shallberesponsiblefortheinvestigationonanddeterminationofdumping.Article4Thenormalvalueofimportedproductsshallbedeterminedinthefollowingwaysont

6、hebasisofdifferentcircumstances:(1)incasethattheproductsofthesamecategoryasthatoftheimportedproductshaveacomparablepriceinthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,thatcomparablepriceshallbethenormalvalue;(2)incasethattheproductsofthesamecategoryas

7、thatoftheimportedproductsarenotsoldonthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,orthepriceorquantityoftheproductsofthesamecategorycannotbeusedasabasisforfaircomparison,thenormalvalueshallbethecomparablepriceatwhichtheproductsofthesamecategoryareexpo
