2、贷款目的与贷款手段双重规制的立法模式，有其创新和突破。但在司法实践中，对骗取贷款行为的打击力度和司法认定方面又稍显不足，本文将以现行法律和法规为基础，结合骗取贷款罪的立法意义，具体分析骗取贷款的认定问题，以适应当前的经济发展和法治要求。本文从三个方面围绕骗取贷款罪的认定进行论证，即骗取贷款罪的内涵、骗取贷款罪的构成、骗取贷款罪与其他罪界限。第一部分骗取贷款罪的内涵，本罪的含义和骗取贷款罪的立法沿革，其中重点讲述的是骗取贷款罪的立法意义；第二部分骗取贷款罪的构成，重点骗取贷款罪客观方面进行论述，如欺骗的手段、银行及金融机构和贷款三个方面对本罪进行论证，对“重
