1、DIRECTIVE2014/68/EUOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCIL2014/68/EU指令2014年5月15日发布ontheharmonisationofthelawsoftheMemberStatesrelatingtothemakingavailableonthemarketofpressureequipment依据各成员国有关法律统一制作，适用于压力设备市场THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,Havingregar

2、dtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle114thereof,havingregardtotheproposalfromtheEuropeanCommission,aftertransmissionofthedraftlegislativeacttothenationalparliaments,havingregardtotheopinionoftheEuropeanEconomicandSocialCommittee,Actinginac

3、cordancewiththeordinarylegislativeprocedure欧洲议会和欧盟理事会，根据欧盟运作条约，特别是第114条款，考虑到来自欧洲委员会的建议，将立法法案草案传给国家议会后，根据欧洲经济和社会委员会的意见，按照普通立法程序，Whereas:鉴于：(1)Directive97/23/ECoftheEuropeanParliamentandoftheCouncilhasbeensubstantiallyamended.Sincefurtheramendmentsaretobemade,thatDirective

4、shouldberecastintheinterestsofclarity.（1）欧洲议会和理事会的97/23/EC指令已大幅修订。既然进一步的修订需要作出，该指令需要重新制定，以清晰说明。(2)Regulation(EC)No765/2008oftheEuropeanParliamentandoftheCouncillaysdownrulesontheaccreditationofconformityassessmentbodies,providesaframeworkforthemarketsurveillanceofproduct

5、sandforcontrolsonproductsfromthirdcountries,andlaysdownthegeneralprinciplesoftheCEmarking.（2）欧洲议会和理事会条例(EC)No765/2008制定了有关合格评定机构认可的规则，为产品的市场监管及来自第三国家的产品控制提供了一个框架，并规定了CE标识的总则。(3)DecisionNo768/2008/ECoftheEuropeanParliamentandoftheCouncil(6)laysdowncommonprinciplesandrefer

6、enceprovisionsintendedtoapplyacrosssectorallegislationinordertoprovideacoherentbasisforrevisionorrecastsofthatlegislation.Directive97/23/ECshouldthereforebeadaptedtothatDecision.（3）根据欧洲议会和理事会第768/2008/EC决议，规定了了共同的原则和旨在适用于部门立法的参考条款，为立法提供统一的修订或重新制定基础。因此97/23/EC指令亦应符合这一决议。(

7、4)ThisDirectivecoverspressureequipmentandassemblieswhicharenewtotheUnionmarketwhentheyareplacedonthemarket;thatistosaytheyareeithernewpressureequipmentorassembliesmadebyamanufacturerestablishedintheUnionorpressureequipmentorassemblies,whetherneworsecond-hand,importedfrom

8、athirdcountry.（4）本指令包含了新投入欧盟市场的压力设备和组件，也就是说，他们或是一个新的压力设备或由欧盟制造商所组装的组件，或是从第三国进口的压力设备和组件，无论是新设备还是二手的。(1)T
