1、中文摘要人们在创造财富的同时，难免会将已拥有的财物遗失。随着社会的发展，人们遗失财物的机率明显增加，因而遗失物拾得制度受到社会各界普遍关注。本文通过对遗失物基本理论研究和对遗失物拾得域外法考察，分析我国遗失物拾得制度发现存在以下不足：没有规定拾得人报酬请求权，使得遗失人与拾得人之间权利义务严重不平衡；规定无人认领的遗失物归国家所有，不利于发挥物的效用并可能造成社会资源的浪费；规定遗失物拾得行为不适用善意取得，加大了市场交易风险。借鉴国外典型国家的成功经验，提出确立遗失物报酬请求权、规定遗失物拾得行为适用善意取得、拾得人附条件取得遗失物所有权等具体建
