3、colonizationinthewesternworld.Atthattime,Francewasdividedintothecountryofthewrittenlawandthecountryofthecustomarylaw.Thesouthernportion,calledthecountryofthewrittenlaw,while,thenorthernregioncametobeknownasthecountryofthecustomarylaw.BothofthetwolawsinFrance,ho
4、wever,wereinfluencedbytheRomanlaw.Andthen,FrancecopieditslawsystemintoitscolonieslikeinCanadaandAmerica.Sodidin1715thecommerceofLouisiana.Intheory,Louisianawasgovernedbythesamesystemoflaw,Romanatfoundation,butmodifiedbystatute,edict,ordinanceandcustom.Spanishin
5、fluenceIn1762,theColonyofLouisianawascededtoSpain.Inthisway,therecameinsomeelementsofSpanishlawandjurisprudence.In1769,asJudgeMartinstateshis“HistoryofLouisiana”,itisbelievedthatthelawsofSpainbecamethesoleguideofthetribunalsintheirdecisions.Butastheselaws,aswel
6、lasthoseofFrance,werebasedontheRomansystem.EnglishinfluenceOnDecember20th,1803,theUnitedStatestookpossessionoftheColonyofLouisianafromFrance.In1804theTerritoryofOrleanswasorganized,includingaboutthepresentareaoftheStateofLouisiana.TakingupthelegalhistoryoftheTe
7、rritoryofOrleans,wefinditsinhabitantsmainlyofFrenchandSpanishdescent,andstronglyattachedtothecivillawinprivatematters.Incriminalmatters,astatuteof1805,whichisstillinforce,adoptedthecommonlawofEnglandasthebasisofdefinitionandprocedure.In1812theterritorywasadmitt
8、edintotheUnionasastate,underthenameofLouisiana.Itwill,therefore,beseenthatthesystemisquiteeclectic.Sofarasgeneralprovisionsinregardtopersons,propertyandobligationsareconcern
