3、,Francewasdividedintothecountryofthewrittenlawandthecountryofthecustomarylaw.Thesouthernportion,calledthecountryofthewrittenlaw,while,thenorthernregioncametobeknownasthecountryofthecustomarylaw.BothofthetwolawsinFrance,however,wereinfluencedbytheRomanlaw.Andthen,Francecopieditslaw
4、systemintoitscolonieslikeinCanadaandAmerica.Sodidin1715thecommerceofLouisiana.Intheory,Louisianawasgovernedbythesamesystemoflaw,Romanatfoundation,butmodifiedbystatute,edict,ordinanceandcustom.SpanishinfluenceIn1762,theColonyofLouisianawascededtoSpain.Inthisway,therecameinsomeeleme
5、ntsofSpanishlawandjurisprudence.In1769,asJudgeMartinstateshis“HistoryofLouisiana”,itisbelievedthatthelawsofSpainbecamethesoleguideofthetribunalsintheirdecisions.Butastheselaws,aswellasthoseofFrance,werebasedontheRomansystem.EnglishinfluenceOnDecember20th,1803,theUnitedStatestookpo
6、ssessionoftheColonyofLouisianafromFrance.In1804theTerritoryofOrleanswasorganized,includingaboutthepresentareaoftheStateofLouisiana.TakingupthelegalhistoryoftheTerritoryofOrleans,wefinditsinhabitantsmainlyofFrenchandSpanishdescent,andstronglyattachedtothecivillawinprivatematters.In
7、criminalmatters,astatuteof1805,whichisstillinforce,adoptedthecommonlawofEnglandasthebasisofdefinitionandprocedure.In1812theterritorywasadmittedintotheUnionasastate,underthenameofLouisiana.Itwill,therefore,beseenthatthesystemisquiteeclectic.Sofarasgeneralprovisionsinregardtopersons
