5、theriskresponsibilityproblemisnotin-depth,andthescholarsaremainlycarringonthecertainresearchtosomeaspectsofthisproblem.Today,theacademestilldoesn'tformasystematictheoryresult,bythecomparativemethodandbenefitofbalance,thisarticlestudiedtheconceptofther
6、iskandriskresponsibilityofthebusinesscontract,anddiscussedafewprinciplesofriskresponsibilityofthebusinesscontract,andconcretelyprobedintotheriskresponsibilityprobleminsomeconcretebusinesscontracts.Onthisbasis,theautherproposedownsuggestionconcerningho
7、wtoperfecttheriskresponsibilitysystemofthebusinesscontract.Keywords:thebusinesscontractriskriskresponsibility在买卖合同中，标的物的意外毁损、灭失直接涉及买卖双方的基本权利与义务，关系到双方当事人的经济利益，因此，风险责任问题是买卖合同屮一个非常重要的理论问题，以至于有的学者认为：“买卖法的目的就在于把基于合同关系所产牛的各种损失的风险在当事人之间进行适当分配。"⑴同时，风险责任问题也是一个
8、容易在当事人Z间产生分歧的焦点问题。在国内和国际贸易领域中，如果当事人没有以明示或者默示的方式对风险责任问题作出约定时，一旦标的物发生意外损失，双方当事人在该损失应山谁承担的问题上，往往会产生激烈的争议。所以说风险责任问题又是一个有着重要实践意义的问题，它不仅受到许多国家或地区立法的重视，而且也受到有关国际条约与国际惯例的重视。在《国际货物买卖统一法公约》的起草过程中，其专门委员会就在报告中指出，风险责任问题是“公约起草者遇到的最须严肃对待的问题之一211980年《联合国国际货物销
