2、0•GroundsforandobjectivesoftheproposalTheproposedregulationaddressestheproblemofthemisuseofcertainchemicals,whicharewidelyavailabletothegeneralpubliconthemarket,asprecursorstohome-madeexplosives.Home-madeexplosives,inturn,arethetoolmostpreferredbyterroristsandothercrimina
3、lstoperpetrateattacks.Themainaimofthemeasuresproposedistoreducethisriskbypreventingaccesstoselectedhighlyconcentratedchemicalsbythemembersofthegeneralpublic.120•GeneralcontextHome-madeexplosives,fabricatedfromcertaineasilyaccessiblechemicalprecursors,areapreferredtoolforp
4、erpetratorsofterroristattacks,fromwhichtheEU,asdocumentedintheEuropolTE-SATreports,isnotspared.Currently,thegeneralpublichasrelativelyeasyaccesstothesechemicalsevenwheninconcentrationssufficienttoproduceapowerfulexplosivedevice.Thescaleoftheproblemisamplifiedbythefactthat
5、thechemicalmarketintheEUislargeanddiversified,withmultipleend-users.Thesupplychainforprecursors,andinparticularthelastsegment(salestoendusers),isingeneralinsufficientlyawareoftherisksposedbyindividualsinvolvedinseriouscriminalactivitiesandterrorismattemptingtoobtainprecur
6、sors.Somesupplychainactors,inparticularattheendofthechain,havesoldprecursorstoterroristsorothercriminalsinquantitiesthatshouldhaveraisedsuspicion.Whileseverallegislativeandnon-legislativemeasuresexistatinternational,EUandnationallevel,theseareeithernotspecificallyfocusedo
7、nthesecurityrisksassociatedwithcertainchemicalsordonotcovertheentireEU.Thisimpliesthatprecursorsthatmayberestrictedorcontrolledinonecountrycanbeeasilyobtainedinanother.Thiscausesnotonlyasecurityproblembutalsoaproblemforthesmoothfunctioningoftheinternalmarket.130•Existingp
