3、rdinatedintroductionofpublicpan-Europeancellulardigitalland-basedmobilecommunicationsintheCommunity(hereinafterGSMDirective)inordertoallowtheuseofsuchbandsbysystemscapableofprovidingelectroniccommunicationservicesnotlimitedtoGSM.Theobjectiveistoallowalargerchoiceofse

4、rvicesandtechnologiesandtherebytomaximisecompetitionintheuseofthebandssofarcoveredbytheGSMDirective,whileensuringthatservicesremaincoordinatedandprotectingthecontinuedoperationofGSM.Todoso,theuseofthisspectrumwouldbeallowed,besidesforGSM,alsoforpan-Europeanelectronic

5、communicationservicesotherthanGSM.Asafirststep,thiswouldincludeUMTS.ThisrequiresnewharmonisedtechnicalconditionsforthespectrumbandinquestionwhichwouldbedefinedpursuanttoaCommissionDecisiontobeadoptedbasedonDecision676/2002/ECoftheEuropeanParliamentandtheCouncilof7Mar

6、ch2002onaregulatoryframeworkforradiospectrumpolicyintheEuropeanCommunity(hereinafterRadioSpectrumDecision).120•GeneralcontextTheGSMDirectivepresentlyrequiresMemberStatestoreservethewhole890-915MHzand935-960MHzbandsforGSM.Thisconstraintpreventsthebandsfrombeingusedbyp

7、an-EuropeansystemsotherthanGSM,capableofprovidingadvancedinteroperablevoice,dataandmultimediaserviceswithahighdeliverybandwidth.Thesenewpan-Europeansystems,suchastheUMTSsystem,offercapabilitiesbeyondtheGSMsystemandhavesincetheadoptionoftheGMSDirective20yearsagobecome
