2、comRegulatoryAuthorityofIndia(TRAI)ActwasenactedtoregulatethedevelopmentoftelecommunicationservicesinIndiaintheMulti-operatorregime.OneofthemainobjectiveofNTP1994wastoprovidetelecomserviceofworldstandardandremovalofconsumercomplaintwithdisputeresolutionwastobegivenasp

3、ecialattention.TheTelecomRegulatoryAuthorityofIndiaAct,1997(Contd.)KeepingtheabovepolicydecisioninmindwhiledefiningthepowersandfunctionoftheTRAIunderChapterIII,Clause11,suitableprovisionwerekepttomeettheaspirationoftheconsumersandtoredresstheconsumergrievances.Dispute

4、settlementmechanismbyTRAIwasenumeratedunderChapterIVoftheTRAIAct1997.SalientFeaturesofTRAIAct1997toEnsureCustomerRightsThefunctionsoftheTRAIshallbeto:Facilitatecompetitionandpromoteefficiencyintheoperationoftelecomservices.Protecttheinterestofconsumersoftelecommunicat

5、ionservices.Monitorthequalityofserviceandconductperiodicalsurveyofsuchprovidedbytheserviceprovider.SettlementofDisputesChapterIVofTRAIAct,1997makesprovisionforsettlementofdisputesamongstserviceprovidersorbetweenserviceprovidersandagroupofconsumers.Itistobenotedthatund

6、ertheTRAIAct,complainofgeneralnatureabouttheserviceprovidedbyanoperatormadebyagroupofconsumersareusuallylookedinto.ComplainofindividualconsumerswhichismaintainablebeforeaconsumerforumunderConsumerProtectionActof1986,areusuallynotconsidered.FormationofTelecomDisputesSe

7、ttlement&AppellateTribunal(TDSAT)Intheyear2000,anordinancewaspromulgatedtoamendtheTRAIActtocreateTDSATtosettlethedisputesbetweentheserviceprovidersandalsobetweentheserviceprovidersandagroupofconsumers.TheauthorityofTRAIforsettlementofdisputesasgiveninChapterIVoftheTRA
