3、echisintegraltodemocracy.Theargumentfromdemocracyemphasizesthatspeechonmattersofpublicinterestshouldreceivegreaterprotectionthanprivatespeech.Thisbookarguesthatfundamentalrulesofdefamationlawneedtobereformedtotakeintoaccountthedualimportanceofpublicinterestspeechontheonehand,

4、andtherighttohumandignityontheother.Inparticular,thepresumptionsthatdefamatoryallegationsarefalseandhavecauseddamage,theprincipleofstrictliabilitytoprimarypublishersandnegligenceliabilitytosecondarypublishers,andtheavailabilityofpunitivedamages,shouldnotsurviveconstitutionals
