4、lationhavedealtprimarily,evenifnotexclusively,withlegalterminology.Andunfortunately,manyofthemarenomorethanexercisesincontrastivelinguistics,thusgivingthereaderafalseimpressionthatlegaltranslationisbutamechanicprocessoftrans-coding.However,itisluckyenoughthatundertheinflu
5、enceofGermanscholars,themainemphasisingeneraltranslationtheoryhasgraduallyshiftedfromlanguagetotheculturalaspectsoftranslation.Andinfact,thelawofacountryorregioniscertainlyinfluencedbyitsculturejustasSarveicput,“Sinceatextderivesitsmeaningfromoneormorelegalsystem,legaltra
6、nslationisessentiallyaprocessoftranslatinglegalsystem”(Sarveic,1997:229).Vermeer’sskopostheorydepartsfromthetraditionbyrecognizingtranslationsassuchworksinwhichthefunctionofthetargettextdiffersfromthatofthesourcetext.Pursuanttotheskopostheory,thetaskoftranslationistoprodu
7、ceatextthatsatisfiestheculturalexpectationsofthetargetreceiversforatextwiththatparticularfunction,herethetranslatornaturallywillplayanactiveroleandneedtofullydisplayhisinitiativeandcreativitytofulfillthefinalcommunicativepurposeofthetargettranslation.Skopostheoryhasitsown
